OSHA uses a gravity-based penalty system defined in the Field Operations Manual (FOM), Chapter 6. Penalties are calculated in a specific sequence — each adjustment factor is applied serially (not cumulatively) to produce the final amount.
1. Gravity-Based Penalty (GBP)
The starting penalty is determined by a Severity x Probability matrix. Severity is rated as high (death/permanent disability), medium (hospitalization), or low (no hospitalization). Probability is greater or lesser. For FY2025, the GBP ranges from $7,093 (low severity, lesser probability) to $16,550 (high severity, greater probability).
2. Size Adjustment
Applied first. Companies with 1-25 employees get a 70% reduction, 26-100 employees get 30%, 101-250 get 10%, and 251+ get no reduction. Willful violations use a separate bracket system with eight tiers starting at 80% for the smallest employers.
3. Good Faith Adjustment
Employers with a comprehensive, documented safety and health management system can receive up to a 25% reduction. The system must include all five core elements: leadership and worker participation, hazard identification, hazard prevention and control, safety training, and program evaluation. This reduction does not apply to high-gravity serious, willful, or repeat violations.
4. History Adjustment
A 20% reduction for employers with a clean record (no serious citations in 5 years or never inspected). A 20% increase for employers with prior serious high-gravity citations that became final orders in the past 5 years.
5. Quick-Fix Credit
A 15% reduction when the employer corrects the hazard immediately during or shortly after the inspection walkaround. Does not apply to high-gravity, willful, repeat, or failure-to-abate violations.
